What matters does LARR assist on?

LARR assists individuals, health providers, and organizations affected by criminal or civil measures burdening or banning abortion and other forms of reproductive care. LARR also assists those charged with criminal offenses for pregnancy outcomes deemed the result of reckless or negligent conduct during pregnancy. In addition, LARR assists those affected by intrusive family regulation resulting in unwarranted termination of parental rights, e.g., as a result of the pendency of pregnancy outcome-related criminal charges.

Examples include:

  • Legal advice on whether seeking out, supporting, or providing abortion services violates the laws in various states
  • Legal advice on data privacy and assistance responding to summonses
  • Representation in civil litigation
  • Criminal defense representation
  • Representation in Child Protective Services proceedings
  • Legal research and amicus briefs for reproductive justice organizations

How do LARR referrals work?

The program coordinator reaches out to the LARR firms by email with a general description of the legal matter. Law firms self-select based on their experience and ability to assist. The firms perform conflict and intake criteria analyses and inform us of availability for the representation.

What is expected from LARR Law Firms?

Law firms accept referrals for cases at their discretion, consistent with their internal intake criteria and conflicts analyses. The firms form an attorney-client or collaborative relationship as warranted by the needs of the matter and perform the work. Firms then provide updates to BASF, consistent with their attorney-client obligations of confidentiality and loyalty. 

Will BASF provide training, resources or malpractice insurance?

BASF conducts Continuing Legal Education (CLE) programs for members of LARR. In addition, BASF will work on facilitating resource sharing with LARR firms where possible. BASF is not in a position to provide individualized mentoring or malpractice insurance.

Can we decline to take on a case?

Yes, each LARR firm elects whether to take the matter presented based on its conflict and intake analyses, subject matter competence, firm resources and level of interest. 

Will referrals be kept confidential?

Yes, conversations between a party and the lawyer referral service program are protected and kept confidential under California law.
