Landlords often use owner move-in (OMI) eviction notices to pressure tenants to give up their long-term tenancies. It is critical that a tenant moving out pursuant to an OMI notice have a lawyer both to do adequate discovery to determine whether the landlord’s claim is true, and to protect the tenant from waiving or releasing any rights, including being allowed back into the rent-controlled unit if the landlord vacates the premises.
