Otis McGee is an arbitrator and mediator who has more than 40 years of litigation and trial experience in matters including labor and employment, products liability, commercial litigation, intellectual property and medical malpractice. After forming his own minority owned law firm, in which he served as managing partner for more than 15 years, he became a partner in a major, international law firm. For nearly five years, he served as the Chief Assistant City Attorney for the City of Oakland where he headed the Litigation Division.
His litigation and trial experience includes a myriad of matters, not limited to products liability, commercial, intellectual property and medical malpractice. In his role as the head of litigation for the City of Oakland, McGee had overall responsibility for the defense of all matters filed against the City, including those involving police excessive force and officer involved shootings; civil rights; construction defects and delay claims, catastrophic injuries and wrongful death matters arising from fires, trees, drownings, bicycle accidents, landslide and subsidence, streets and roads and dangerous conditions of public property. He is well versed in litigation of all types, involving public entities, including commercial disputes related to professional sports teams and utility providers.
Over his career, McGee has been responsible for the litigation, through trial and appeal of labor & employment matters, ranging from single and multiple plaintiff discrimination, sex harassment, hostile work environment, wage & hour class actions, trade secrets and employee mobility/ADA disputes. His products liability cases have included those arising out of accidents involving automobiles and light trucks, consumer appliances and industrial equipment, pharmaceuticals and medical devices. He has also handled landlord/tenant disputes, family law matters and cases involving environmental issues.
McGee received his Juris Doctorate from the University of California, Berkeley, School of Law. He is an accomplished trial attorney. He is a member of the American Board of Trial Advocates (ABOTA), a Fellow in the American College of Trial Lawyers, and a member of the Litigation Counsel of America.
He is a frequent lecturer on continuing legal education subjects and he has served on the Faculty of the ABOTA/ABA TIPS National Trial Counsel Program, a week-long trial advocacy program conducted at the National Judicial College in Reno, NV. He is frequently invited to participate on the faculty of the annual ABOTA Masters in Trial Program. McGee is a Consulting Editor of the Mathew Bender publication, “Civil Procedure During Trial.”
McGee’s mediations include those involving personal injuries arising from labor & employment related to wrongful discharge, sex harassment, and wage & hour class actions; automobile accidents; premises liability arising from slips and falls, Assisted Living Facility liability for injuries to elderly patients.
Hourly Rate: $600; discounted rates for matters involving public entities.
