Carol M. Kingsley is an experienced and flexible mediator with over 30 years of experience practicing law and resolving conflicts. She works full time as a neutral, primarily a mediator, specializing in business disputes, real estate/construction and estate/trust/will conflicts. Kingsley brings to mediation her substantial experience as a business and tax lawyer: negotiating transactions; facilitating business formations, mergers, acquisitions, and dissolutions; litigation; estate planning; handling real estate and landlord/tenant matters; construction contracting; and advising on general corporate, partnership, securities, consumer, trademark and trade secret, tax and employment law. She has mediated to settlement hundreds of cases involving these same subject matters.
Kingsley earned a JD with MBA in Taxation as well as a National Association of Securities Dealers license. She has had an AV rating, the highest attorney rating, from Martindale Hubbell for 30 years. She also has more than 500 hours of specialized and advanced training for mediation, arbitration and facilitation. Kingsley is certified by the Dispute Resolution Board Foundation for construction contracts.
For four years, Kingsley served on the San Francisco Police Commission and was a hearing officer on serious police misconduct cases, including issues of excessive force and honesty. She participated in decisions on almost a hundred misconduct cases, many involving termination. She is available to mediate police misconduct cases.
Kingsley is trained and experienced in many mediation methods, including facilitative, evaluative and transformational and uses the method or combination of methods she believes to be most effective in a particular mediation. Each case is unique, and Kingsley tries to be responsive to the needs of the parties and their attorneys. She works hard to help parties resolve their conflict completely, and if that is not possible, then for the parties to walk away with some issues resolved or at least a clearer understanding of what might resolve the conflict in the future. Kingsley strives for all parties in her mediations to feel the mediation was conducted fairly and ethically, that they had an opportunity to be fully heard and that all possibilities for settlement were explored as fully as the circumstances would allow.
In addition to her private practice, Kingsley mediates cases for non-profit organizations, courts and government entities. The panels she has been on include: Congress of Neutrals where she supervises mediators, Contra Costa Courts, US District Court of Northern California, FINRA, California State Department of Insurance, Dispute Resolution Board Foundation, The Bar Association of San Francisco, and Marin Mediation Services.
Professional affiliations include American Bar Association, Alternative Dispute Resolution Section; The Mediation Society; The Association for Conflict Resolution, Commercial Section; the Bar Association of San Francisco; Dispute Resolution Board Foundation; and FINRA.
Hourly Rate: $450 with lower rates for qualifying parties and higher rates for more than 3 parties. No charge for the first hour of travel time.
