PROGRAMMING

  • The State Regulatory Labor and Employment Landscape
    At the beginning of this Administration, we anticipated that federal action/inaction would likely impact how states, including California, chose to deal with an array of labor and employment issues ranging from leave, sexual harassment, wage and hour classification, to immigration issues. This panel will examine what's occurred and how state legislative and regulatory activities have been shaped by the actions and priorities of the current Administration and Congress.

  • New Developments in Collective Action Litigation: PAGA, Arbitration, and Class Action Waivers
    This panel will discuss new developments including pending California Supreme Court cases, the tension between arbitration agreements and collective action suits, mandatory arbitration and class action waivers, and other trends in collective action litigation.

  • Unpacking The High Profile Sexual Harassment Case: What The Players Are Actually Up To Before The Lawsuit Hits
    As a high profile sexual harassment matter unfolds, the key legal players — counsel to the company, counsel for the accuser, counsel for the accused, the investigator and the mediator who will be asked to resolve it — all must swing into action under competing pressures and play very different roles and pursue very separate agendas. In this panel, the lawyers playing those roles will talk about what is on their agendas as they represent their clients or perform their functions, what critical strategic and tactical issues they face and should anticipate, and how they measure success.

  • The Impact of the #MeToo Movement on the Prevention and Resolution of Sexual Harassment Claims
    As the #metoo movement continues to grow, California has strengthened its anti-discrimination laws, sexual-harassment-prevention training requirements, and rules for settling allegations of sexual harassment. This panel will address how employers, workers and unions are responding to these changes, and ethical and effective negotiation of settlements of sexual harassment claims.

  • Supporting Transgender Employees: Legal Update and Practical Guidance for Creating Inclusive Workplaces
    This panel of experts in transgender employment law and workplace inclusion will share the latest regulatory and case law updates from this rapidly-evolving area of law, and offer practical training advice and guidance for law firms and companies to support transgender employees.

  • Technology and the Future of Work: Are We Prepared for the Changes Ahead
    Just a couple of decades ago, no one could have predicted what today's workplace would look like. The future of work continues to be uncertain but is evolving at ever increasing speeds. This panel will look at how current technology intersects with emerging labor and employment issues and is likely to impact the future of work, including compensation schemes of the future, the uses of artificial intelligence in the workplace, the impact of automation and robotics, navigating the use of employee social media and other nontraditional communication tools, compliance with the biometrics legal landscape, and the gig economy.
