Approximately fifty energy companies have been sued by counties and municipalities across the country on theories of state common law nuisance and similar causes of action for alleged climate-change related harms. The suits present important legal questions left open by previous climate change litigation, including AEP v. Connecticut, 564 U.S. 410 (2011) and Native Village of Kivalina v. ExxonMobil Corp., 696 F.3d 849 (9th Cir. 2012).

Program Panelists Will Discuss
• The status of the common law of climate change after AEP and Kivalina
• The policy implications of adjudicating climate change-related tort claims under state law
• Whether tort suits concerning climate change-related harms present non-justiciable political questions
• The appropriateness of imposing tort remedies upon fossil fuel producers to abate the "public nuisance" of climate change
