As the FBI's general counsel has admitted, the Supreme Court's decision in United States v. Jones represented a "sea change" in the law. This CLE examines the ongoing struggle court's are facing in attempting to fit new technologies within the contours of the Fourth Amendment. We will review recent cases applying the Fourth Amendment to technologies like email, tweets and cell phone location data, discuss the three wildly different opinions in Jones, and examine how Jones signals the beginning of a new line of Fourth Amendment challenges to electronic searches and seizures.
