"Mr. Petersen was the mediator selected by the Northern District ADR program in a sexual harassment case in which the EEOC was the plaintiff, we represented four intervenors and the defendant was a large food production company. My colleague, Dan Torres, and I represented the intervenors, defendant's former employees, all of whom were low-wage monolingual Spanish speakers. It was a very contentious case and after the plaintiff and plaintiff/intervenors exchanged mediation briefs with defense counsel, it seemed as though the parties were not only miles apart, but planets apart. As such, when the mediation began at 9:30 am, we expected the mediation effort to be a short exercise in futility.
