Areas of Experience: Probate, Trust, Legal Malpractice: all actions arising under the Probate Code, including actions for fraud, undue influence, forgery or mistake, objections to a fiduciary’s accounting, actions to remove or surcharge a trustee or executor or other fiduciary, contested conservatorships or guardianships, and actions alleging elder abuse, whether brought under the Probate Code or the Welfare & Institutions Code.


Margaret M. Hand has been mediating trust and estate disputes, and disputes arising under Conservatorship and Guardianship Law, since 2004.  She has litigated disputes arising in these areas since 1993.  She is a California State Bar Certified Specialist in Estate Planning, Trust and Probate Law and is the author of many of the practice guides relied upon by attorneys who practice in this area.

Hand is professional, personable and tenacious.  She remains calm in emotionally charged situations, listens with empathy and understands the dynamics that can make family disputes so hard to resolve.  Hand encourages parties to craft their own solutions, but she is not afraid to use her expertise and experience when an evaluative approach is needed.  She teaches fiduciary accounting to both attorneys and accountants and enjoys the challenge of mediating financially-complicated disputes. 

Hand is a graduate of UC Berkeley School of Law (Boalt Hall) and a fellow of the American College of Trust and Estate Counsel.  She has trained as a mediator locally and through Harvard Law School’s Program on Negotiation.
