Ben Hamburg

After graduating from Boalt Hall in 1979 and spending a year as a law clerk to the Hon. Ira Brown, Ben Hamburg became a commercial litigator. Since 1993, he has served as a mediator, arbitrator and attorney. He was General Counsel for a mortgage lender from 2001-2004.


Hamburg has received high praise for his abilities as a mediator. George Yuhas of Orrick Herrington had the following to say about him: "This is the third attempt to mediate this case. And Mr. Hamburg was far and away the best mediator. I dare say we would not have settled today but for his efforts." Mary Swann made the following comment: "[Mr. Hamburg was] wonderfully forceful--just what was needed." One judge stated Hamburg was "at the top of the mediator 'Hall of Fame." Others have commended him as thoughtful, respectful, and creative.

Hamburg establishes a rapport with litigants and counsel, and is adept at listening, defusing emotional blocks and building cooperation.

Since each case has its own set of dynamics and personalities, Mr. Hamburg utilizes the mediation approach that is best suited to the particular case; however, he generally believes that his role is not simply to act as a "play-back machine," who simply communicates positions between warring parties, but instead to assist the parties in understanding the strengths and weaknesses in the case, and oftentimes suggesting creative solutions that the parties have not before considered.

Hamburg has been involved in well over 100 mediations and settlement conferences over the past 25 years. In addition to his hands-on experience, he has trained as a mediator by participating in the United States District Court's selective mediation training program and in private mediation courses.
